On the website of the Ministry of Finance in the Public Information Bulletin were published the follwing: a draft law amending the Law on tax on goods and services, road transport law and the law amending the Law on tax on goods and services (2 July 2009). Information about this project was also communicated to all Members of the Association.

PIU critical to the procurement of group insurance

The Polish Insurance Association sent a letter to Mr. Jacek Sadowy, the president of the Public Procurement Office, criticising the opinion of the UZP entitled “Award of contracts for employee group life insurance”. The Procurement Office recommends the use of the Public Procurement Law in the context of contracts of group life insurance.

The European Commission expects clarification from the Polish authorities on liquidation of towing vehicles without MTPL

The European Commission responded to the information provided by Polish Insurance Association on 1 June this year on non-compliance with the EU standards governing the Polish law for drivers to hold mandatory liability insurance policy (OC). PIU appealed to the EC amendment of the Law on Road Traffic about liquidation of the right of the police to tow a vehicle without OC and not introducing in its place any other penalties.

The trial against Casus

Legal proceedings have started against Casus Investigation of Insurance Claims company, which, according to the Polish Insurance Association, misleads customers through their advertisements, by giving false information on insurance companies. District Court in Warsaw has already given the case a signature II C 620/09.

PIU work on a new law on tourist services

Polish Insurance Association supports the idea of a Travel Security Fund (FZT) – a mechanism for protecting clients against unfair travel agencies. The fund would be based on contributions paid by all tour operators. The contribution will depend on a type of service – the highest would be paid for a customer who is sent on charter trip, less for the client sent on a bus trip or youth trip. This system would complement the current model of the guarantee provided by commercial insurers. The guarantee would remain the basis for the system. PIU also proposes that the charter tour operators could operate only as joint-stock companies – perhaps with a larger amount than the statutorily required 0.5 million PLN. From this point of view, charter tour oparators are most likely to announce the bankruptcy.
